Disputes within a company or a fund often involve directors, shareholders, investors, professional advisers and third parties or a combination of some or all of them. As a result, it is a fraught and difficult area of the law. As experts in litigation our partners have seen these disputes from all sides.
For example, one of our partners (James Gleeson) gave expert evidence as to the Jersey law of prescription on claims against directors over a ten day hearing in the High Court of England and Wales (O’Keefe & Anor v Caner & Ors [2017] EWHC 1105 (Ch)).
We also acted for the successful appellants in Consolidated Resources Armenia v Global Gold & Others [2015] JCA061, a multimillion dollar shareholders’ dispute which clarified Jersey law on the Court’s power to stay proceedings in favour of arbitration.
